Buying Property in Kenya
From Abroad

A complete guide for Kenyans in the diaspora and international buyers looking to invest in Kenyan real estate.

How to Buy Property in Kenya from Abroad

Six steps to owning property in Kenya, even if you are thousands of miles away.

STEP 01
Define Your Budget & Goals
Decide whether you want to invest for rental income, buy a holiday home, or purchase for retirement. Your goal shapes your budget, location and property type.
STEP 02
Engage a Kenyan Lawyer
Hire a conveyancing lawyer in Kenya before anything else. They will conduct due diligence, verify title deeds and ensure the property is free of encumbrances.
STEP 03
Visit or Use a Trusted Agent
If possible, visit Kenya to view properties. If not, work with a verified PrimeVale agent who can conduct virtual tours and provide independent assessments.
STEP 04
Transfer Your Funds
Use a regulated currency transfer service (not informal channels). Ensure funds arrive via official banking channels to satisfy Anti-Money Laundering requirements.
STEP 05
Sign the Sale Agreement
Your lawyer reviews and signs the sale agreement on your behalf. A 10% deposit is typically paid at this stage, held in your lawyer's client account.
STEP 06
Complete Transfer & Registration
Your lawyer handles stamp duty payment (4%), title transfer at the lands office, and registration. The process takes 60–90 days from agreement to title.

Frequently Asked Questions

Can a Kenyan in the diaspora legally own property in Kenya?
Yes. Kenyan citizens living abroad have the same property rights as residents. Non-citizens can also own property in Kenya, though land ownership has some restrictions for non-citizens.
Do I need to be in Kenya to buy property?
No. You can legally complete a purchase remotely by giving your lawyer a Power of Attorney, which authorises them to sign documents and complete the transaction on your behalf.
How do I transfer money to Kenya for a property purchase?
Use a regulated forex or bank transfer service. Funds must come through official banking channels. Avoid informal channels (hawala) as they will not satisfy AML requirements during title transfer.
What taxes do I pay when buying property in Kenya?
Stamp duty of 4% of the property value is payable by the buyer. Legal fees are typically 1–2%. Annual land rates and property rates apply once you own the property.
Can I get a mortgage as a diaspora buyer?
Some Kenyan banks offer diaspora mortgage products, typically requiring proof of income in your country of residence. KCB Bank and Equity Bank have diaspora banking divisions that offer mortgage products.
How do I manage my property while living abroad?
Engage a professional property management company in Kenya. They handle tenant sourcing, rent collection, maintenance and reporting. Fees typically range from 8–12% of monthly rent.
