1Definitions
For the purposes of these Terms: "PrimeVale", "we", "our" and "us" refer to PrimeVale Kenya Limited. "Site" refers to www.primevale.co.ke and all mobile versions and applications derived from it. "Advertisers" and "listers" refer to private sellers, agents, property developers, landlords and ancillary partners. "User" refers to any person accessing or using the Site.
2Acceptance of Terms
Please read these Terms carefully before accessing or using the services made available through www.primevale.co.ke (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. You will also be required to review and agree to our Privacy Policy before you can access and use the Site. Advertisers who use the Site must accept and adhere to the Advertiser's Terms and Conditions.
3Personal Information
You do not have to create an account to use the Site, but certain areas are only available to registered users. If you create an account, you will be required to submit certain personal information as part of the registration process. Our Privacy Policy governs how we deal with your personal information. Please review it carefully to understand our practices.
4Copyright and Trademarks
All content on the Site — including service marks, trade marks, designs, code, images, property content, product information, pricing data, advertisements, user interface design, software and all other forms of media — is owned or licensed by PrimeVale Kenya Limited and is protected by local and international law on copyright and intellectual property. You may download material from this Site for your personal use provided you keep intact all copyright and proprietary notices.
6Listing Content and Accuracy
PrimeVale does not endorse or recommend any advertisers, agents, property developers, private sellers, or ancillary partners on the Site. All listings are provided by third-party advertisers and PrimeVale does not independently verify the accuracy of listing information. We strongly recommend you obtain independent legal, accounting, and financial advice before entering into any agreement with any advertiser on the Site. It is your sole responsibility to evaluate the accuracy and completeness of all information provided through the Site.
7No Guarantee of Availability
PrimeVale gives no guarantee of the continued availability of any particular property advertised on the Site and will not be liable should an advertiser have sold or withdrawn a property at any time prior to removal of the listing. Whilst we take reasonable efforts to ensure that listing data is accurate, we give no guarantee that every property description is free from errors or inaccuracies.
8Third Party Sites and Links
The Site may provide links to websites maintained by third parties. These links are provided for convenience only and do not imply endorsement by PrimeVale. Such linked sites are not under the control of PrimeVale and we are not responsible for their content, accuracy, legality or decency. PrimeVale will not be liable for any damages or loss arising in connection with any information or third-party service provided by any third party.
9No Guarantee of Service
We do not warrant that the services available through the Site will be uninterrupted or error-free, or that defects will be corrected. You acknowledge that PrimeVale cannot guarantee that files available for downloading or delivered via email will be free of viruses or other harmful code. You are responsible for implementing sufficient procedures for accuracy of data input and output, and for maintaining a means to reconstruct any lost data.
10Account Security
To become a registered user, you must provide a password and username. You are entirely responsible for maintaining the confidentiality of your login details and for all activities that occur under your account. You shall immediately notify PrimeVale of any unauthorised use of your account or any breach of security. You may change your password at any time through the Site settings.
11No Misrepresentations
You undertake that you will not, through any act or omission, mislead or deceive others in the course of using the Site. Where a valid complaint is made or PrimeVale establishes through its own investigations that you have misled or deceived others, PrimeVale has the right to suspend or permanently remove your account.
12Variation
PrimeVale may modify these Terms at any time. Such modifications shall be effective immediately upon the modified Terms being posted on the Site. Where you are a registered user, PrimeVale may post a notification of updated terms on your account dashboard.
13General Provisions
If any part of these Terms is or becomes invalid, illegal or unenforceable, it shall be modified to the minimum extent necessary to make it valid and enforceable. We may transfer our rights and obligations under these Terms to another organisation and will notify you if this happens. These Terms are governed by the laws of Kenya and you irrevocably submit to the exclusive jurisdiction of Kenyan courts.
